By
filling out the Affiliate Signup form you acknowledge that you have read the
terms and conditions, understand, and agree with them.
1.
Joining the Program
On
successful completion of the Affiliate Signup Form you will automatically
become an Affiliate of Correo Inteligente affiliate program, and are bound by
the terms of this agreement. Your participation in the program is solely for
the following purpose:
To
legally advertise the Correo Inteligente website www.correointeligente.com
, products
and/or services in order to receive commissions through successfully referred
customers.
2.
Terms of the agreement
These
terms will begin upon your signup with the affiliate program and will end when
your affiliate account is terminated. The terms of this agreement may be
modified by us at any time. If any modification to the terms is unacceptable
to you, your only choice is to terminate your affiliate account. Your
continuing participation in the program will constitute your acceptance of any
change.
The
Affiliate has the right to terminate this Agreement at any time upon written
notification (by email) to Correo Inteligente
Your
affiliate application and status in the program may be suspended or terminated
for any of the following reasons:

Inappropriate
advertisements (false or misleading claims, misleading hyperlinks)

Spamming
in any shape or form (mass email, mass newsgroup posting, unsolicited
email etc...)
-
Advertising
on sites containing/promoting illegal activities
-
Violation
of intellectual property rights, copyrights, trademarks.

Sexual
exploitation
-
Promoting
violence
-
Libelous
or defamatory advertising
-
Threatening
or abusive action
-
Illegal
activities
-
Action
judged by us to be in poor taste such that we do not wish to be
associated with.

3.
Affiliate Links
You
may use graphic and/or text links both on your website and in emails. You can
also advertise 'offline' in classified ads, magazines, newspapers etc.
You
may use the graphics and text provided to you by us, or you can create your
own as long as they are deemed appropriate according to the conditions above
in '2. Affiliate Status'.Again,
if you are unsure about acceptability, PLEASE CONTACT US FIRST!
4.
Affiliate Web Sites
As
an Affiliate you are solely responsible for any and all materials that appear
on your Web site, and for adhering strictly to all laws and regulations
applicable to the conduct of your business and in particular to the marketing
and advertising of Correo Inteligente products/services.
5.
Spamming
Should
a complaint be received that an Affiliate is spamming, Correo Inteligente reserves
the right to immediately suspend an Affiliate. The complaint shall be
investigated by, and final judgment made by, Correo Inteligente.
If
judged that spamming HAS occurred, the Affiliate's account will be terminated
immediately and any commission's earned by the Affiliate AFTER the date on
which the initial spamming complaint was received (or earned as a result of
any spamming activity) shall be nullified.
Affiliates
who spam shall be liable for payment of ALL losses and damages suffered -
either directly or indirectly - as a result of their spamming activities. NO
FORM of Spam shall be tolerated.
6.
Commissions & Payment
Commissions
are awarded when - as a result of successful marketing and advertising efforts
- you, the Affiliate (or one of your sub-affiliates), refers a new paying
customer to Correo Inteligente products/services.
Commissions
are paid ONLY on payments actually made and are based upon the paid selling
price of the service, before any other deductions (such as Tax) are made. Commissions
as of 1st December 2001 -unless otherwise stated- are: 40%
7.
Refunds & Chargebacks
In
the event that a customer shall request and be granted a refund of any sums
paid for services or products provided by Correo Inteligente, we shall be entitled
to reclaim all associated commissions.
This
provision also applies to any 'chargebacks' received, for example (but not
limited to) a chargeback resulting from the misuse of a credit card during the
purchase of our products or services.
8.
Taxes
Affiliates
are responsible for ALL taxes and similar levies applicable to the receipt of
any sales commissions pursuant to all laws and regulations. You, the
Affiliate, are responsible for reporting all commissions received to your
appropriate tax authorities.
9.
Liability
We
will not be liable for either indirect or accidental damages (loss of revenue,
commissions) due to affiliate tracking failures, loss of database files, and
any results of "intents of harm" to the program or our website.
We
do not make any expressed or implied warranties with respect to the affiliate
program and/or products sold at this site. No claim is made that the operation
of the affiliate program and our website will be completely error-free and we
will not be liable for any interruptions or errors.
The
Affiliate agrees to indemnify Correo Inteligente against any claim or demand,
(including legal fees) made by a third party and due to (or arising out of)
the Affiliate's activities.
10.
Relationship between Correo Inteligente and its Affiliates
All
Affiliates shall remain as independent contractors and are not employees or
agents of Correo Inteligente. Nothing in this agreement constitutes a
partnership, joint venture, agency or franchise between the parties. No false
representations shall be made by affiliates in respect of this.
14.
Communication
All
communication between the parties, or their representatives, shall be
conducted in the English language.
